NO WARRANTIES AS TO PERFORMANCE, SUITABILITY OR MERCHANTABILITY ARE GIVEN. SPECIFICALLY (AND WITHOUT PREJUDICE TO THE GENERALITY OF THE FOREGOING), THE COMPANY DISCLAIMS ANY STANDARD OR IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY.

In utilizing the service or any of the information, the User, expressly accepts and assumes the risk of errors and/or omissions in the information provided, and in its translation or transmission. The User also accepts and assumes full responsibility for implementing sufficient procedures and checks to satisfy the User's requirements for accuracy of the analyses of the information. The User also specifically acknowledges that no warranties, agreements or representations, expressed or implied, including any warranty of suitability, merchantability or fitness for any particular purpose, have been made by or on behalf of the Company, and that no warranties exist except as are expressly stated in writing. The Company shall not in any event be liable for any loss or damage or whatever (including, without limitation, any actual, incidental or consequential loss or damages), or penalties, towards the User or any other person, organization or entity, arising out of the use, loss of use or inability to use the service for any reason or purpose whatsoever.
IF NOTWITHSTANDING THE ABOVE PROVISION, ANY LIABILITY ON THE PART OF THE COMPANY SHALL EXIST OR ARISE UNDER ANY APPLICABLE LAW, THEN SUCH LIABILITY (WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE OR FOR ANY OTHER REASON WHATEVER, SHALL BE LIMITED TO ANY SUMS RECEIVED BY THE COMPANY FROM THE USER UNDER THE NON-EXCLUSIVE SUBSCRIPTION AND AGREEMENT OR IN PAYMENT FOR THE "ASK THE EXPERT" SERVICE. THE MAILING OF A BANK CHEQUE FOR SUCH SUMS RECEIVED TO THE LAST GIVEN ADDRESS OF THE USER SHALL CONSTITUTE AN ABSOLUTE WAIVER AND DISCHARGE OF ALL CLAIMS WHATEVER AGAINST THE COMPANY, ITS LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS AND/OR SHAREHOLDERS.
Neither the Company nor any of its licensors, officers, directors, employees, affiliates, or agents or shareholders shall be liable for any loss resulting from delays or interruptions due to electronic or mechanical equipment failures, or telephone interconnect connection problems or defects, or to storms, strikes, walkouts, fire, acts of God, riots, armed conflict, acts of war, or to other causes over which they have the Company has no direct control, or loss resulting form erroneous statements or error of fact, or in transmission. The Company, shall have no responsibility or liability to provide any services to the User during the period which while interruption of service due to any such cause shall continue, nor during any additional period required for the reactivation of the services following cessation of such cause.
